Q: I am a sick man, and I have one son who is mentally ill, and I have twelve daughters. Allah the Exalted has granted me much wealth—praise and thanks belong to Him—and I have more than ten houses and other farms. I desire to endow one of the buildings and the farm in front of it for my daughters, to serve as a residence for any of them who is divorced and to benefit from the farm's produce, or for any of them who is troubled by her children and needs a residence. This is because I fear for them after my death. I was unable to do this except after a ruling from the scholars of knowledge, so that I may be certain of my matter. May Allah preserve you.
A: There is no harm in a person endowing for those of his daughters or sons who are in need during his lifetime; for what came in al-Bukhari as a suspended narration with a form of certainty, that al-Zubayr ibn al-Awwam (may Allah be pleased with him) gave in charity his turn and said: "It is for the divorced among his daughters to reside there, provided she does not cause harm and is not harmed by it. If she becomes wealthy through her husband, she has no right [to it]." And it was narrated with a connected chain by al-Darimi in his (Sunan), and al-Bayhaqi in (al-Sunan al-Kubra), and Ibn Abi Shaybah in (his Musannaf), and because an endowment is not a transfer of ownership of the asset, but rather it is only enabling the needy person to benefit from the utility.
