And after that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the inquirer, the Shaykh: Nahi' ibn Mutlaq al-Harbi , Chairman of the Board of Directors of the 'Umar ibn al-Khattab Charitable Association in al-Fawliq in al-Qasim , which was referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (451) and date 22/3/1431 AH. The inquirer asked a question, the text of which is as follows: You know, may Allah preserve you, the importance of charitable endowments for charitable associations, because they have a good return that benefits needy families and serve as a source of income for the association. We at the 'Umar ibn al-Khattab Charitable Association are striving hard to invest in real estate. We have a piece of land with an area of more than fifteen thousand square meters, donated by one of the benefactors to build a wedding hall on it, to be included in the association's endowments. This is due to the urgent need for a wedding hall, as there is no wedding hall in the town for holding events, and it is also considered a successful investment project with a good return for the association.
Our question, Your Eminence: Is it permissible to invest the association's funds, excluding zakah, in establishing this project? This is due to the urgent need, knowing that the contract with the tenant will state that no prohibited matter contrary to the Shari'ah is to be carried out, and this is left to the tenant, similar to other wedding halls. We ask Your Eminence to inform us about this, and may Allah preserve and protect you.
After studying the inquiry, the Committee answered that it is permissible to invest the charities and donations received by the aforementioned association through permissible means, such as building a wedding hall, provided that its proceeds are spent on the association's interests, as long as these funds are not from zakah and as long as the donor has not stipulated a condition regarding what he donated, in which case it must be spent according to his condition.
