A43: The scholars are in agreement that zakah is obligatory in gold and silver jewelry if it is jewelry whose use is forbidden, or if it is intended for trade or the like.
As for jewelry that is permissible and intended for use or lending, such as a silver ring, women's adornments, and what is permitted of weapon adornments, the stronger opinion among the scholars is that there is no zakah on it; because through permissible use, it becomes of the nature of clothing and goods, not of the nature of currency. This is what the Companions (may Allah be pleased with them) followed. It was narrated from A'ishah (may Allah be pleased with her) that she used to look after the orphaned daughters of her brother in her care, and they had jewelry, but she did not pay zakah on it. Malik narrated this in al-Muwatta'. al-Daraqutni also narrated it with his chain, from Asma' bint Abi Bakr (may Allah be pleased with her), that she used to adorn her daughters with gold and did not pay zakah on it, even though it amounted to about fifty thousand. Abu 'Ubayd said in his book al-Amwal: Isma'il ibn Ibrahim narrated to us, from Ayyub , from Nafi' , from Ibn 'Umar , that he used to marry off one of his daughters for ten thousand, and he would make her jewelry worth four thousand from that. He said: "So they did not give anything for it," meaning: zakah. He also said: Isma'il ibn Ibrahim narrated to us, from Ayyub , from 'Amr ibn Dinar , who said: Jabir ibn 'Abdullah was asked: "Is there zakah on jewelry?" He said: "No." It was said: "Even if it reaches ten thousand?" He said: "That is a lot."
