A letter was received by His Eminence the Grand Mufti from His Eminence Shaykh: Fahd ibn Saleh al-Bahuth , the judge at the General Court in Thaqif , bearing number (365) and dated 28/8/1426 AH, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (3014) and dated 8/9/1426 AH. His Eminence asked a question, the text of which is as follows: We inform you that in the region of Thaqif (south of al-Ta'if ) and the neighboring areas, there are certain customs and traditions that people have followed since ancient times. Some of the residents of this region have inherited the practice of making a will before death to be buried with their father, mother, or sister, and so on. Based on this, the grave of the deceased is opened after a year or more, then his bones are gathered and placed on one side of the grave, and the deceased who made the will is placed next to those bones and buried. It is known that the custom here is to dig a side niche (shaq) rather than a side chamber (lahd), due to the hardness of the ground in some cases. We hope that Your Eminence will clarify the ruling on this matter according to the Shari'ah.

After the Committee studied the inquiry, it responded that the original ruling is that every deceased person should be buried in a separate grave; because the Prophet (peace and blessings be upon him) used to bury every deceased person in a grave, and the practice of the Companions and those who came after them continued on this basis. Therefore, no consideration is given to a will that contradicts this.
