Q1: A woman was in the waiting period following her husband's death, and during this waiting period, her name was selected among the pilgrims for last year. Given the difficulty of obtaining this permission to perform Hajj, she ended her waiting period early and performed Hajj. When she returned from Hajj, some people told her that her Hajj was invalid. Is this statement correct, and is her Hajj valid or not? Please issue a ruling, may Allah reward you.
A1: It is obligatory for a woman in the waiting period following her husband's death to remain in the marital home until her waiting period ends, based on the hadith of Fari'ah bint Malik al-Khuzari, who said:
My husband went out in search of a cure for his illness, and they caught up with him at the edge of the land and killed him. The news of my husband's death reached me while I was in a house belonging to the Ansar, which was far from my family's house. I came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah, the news of my husband's death has reached me while I am in a house far from my family's house and my brothers' house. My husband left no money to support me, no money for me to inherit, and no house that he owned. If you see fit to allow me to return to my family's house and my brothers' house, that would be better for me and more comprehensive for some of my affairs. He said: Do so if you wish. She said: I went out, my eyes dimmed, by what Allah had decreed for me through the tongue of the Messenger of Allah (peace and blessings be upon him). Until I was in the mosque or in one of the rooms, he called me and said: What did you claim? She said: I recounted it to him. He said: Remain in the house where the news of your husband's death reached you until the book reaches its term. She said: So I observed the waiting period there for four months and ten days.خرج زوجي في طلب أعلاج له فأدركهم بطرف القدوم فقتلوه فجاء نعي زوجي وأنا في دار من دور الأنصار شاسعة عن دار أهلي فأتيت النبي صلى الله عليه وسلم فقلت يا رسول الله: جاء نعي زوجي وأنا في دار شاسعة عن دار أهلي ودار إخوتي ولم يدع زوجي مالاً ينفق علي منه ولا مالاً ورثته ولا دارًا يملكها، فإن رأيت أن تأذن لي فألحق بدار أهلي ودار إخوتي فإنه أحب إلي وأجمع لي في بعض أمري قال: فافعلي إن شئت قالت فخرجت قريرة عيني لما قضى الله لي على لسان رسول الله صلى الله عليه وسلم حتى إذا كنت في المسجد أو في بعض الحجرة دعاني فقال: كيف زعمت؟ قالت: فقصصت عليه فقال: امكثي في بيتك الذي جاء فيه نعي زوجك حتى يبلغ الكتاب أجله قالت: فاعتددت فيه أربعة أشهر وعشرًا
. It was narrated by the people of the Sunan. This woman, when she went out for Hajj while in her waiting period, committed this sin. However, this does not affect the validity of her Hajj; rather, her Hajj is valid, albeit with the sin.
