The Shaykh : As for the woman whose husband has died, it is not permissible for her to leave her house and travel for Hajj until the waiting period is completed, because in this state she is not able to perform it, as she is required to wait in the house, as Allah the Exalted said:
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days] وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
[Al-Baqarah 2:234]
Therefore, she must wait in her house until the waiting period ends. As for the woman in a waiting period other than due to death, the woman whose divorce is revocable has the ruling of a wife, so she does not travel except with her husband’s permission. However, there is no blame on him if he sees that it is in the interest to permit her to perform Hajj, and she performs it with a mahram (a relative one may not marry). As for the woman whose divorce is irrevocable, it is prescribed that she also remain in her house, but she may perform Hajj if the husband agrees to it, because he has the right during this waiting period. So if he permits her to perform Hajj, there is no blame on her. The conclusion is that the woman whose husband has died must remain in the house and not go out. As for the woman whose divorce is revocable, she is in the ruling of wives, so her matter is up to her husband. As for the woman whose divorce is irrevocable, she has more freedom than the one whose divorce is revocable, but even so, her husband has the right to prevent her to protect her waiting period. Yes.
