Fatwa No. ( 15572 )
Praise be to Allah alone, and may peace and blessings be upon the one after whom there is no prophet. The Permanent Committee for Scholarly Research and Ifta has reviewed the inquiry submitted to His Eminence the Grand Mufti by the questioner (M. S. Q.), referred to the Committee by the General Secretariat of the Council of Senior Scholars, with reference number (5065) and dated 7/10/1413 AH. The questioner requested an examination of the mosque whose traces are located within the courtyard of his house in Ahd Rafidah . The request was forwarded to the honorable judge of Ahd Rafidah via letter number (2405/2), dated 22/8/1413 AH, to form a committee from the court, the Commission for Promoting Virtue and Prohibiting Vice, and the Waqf Authority to inspect the site of the aforementioned mosque and prepare a detailed report on it. A response was then received via letter number (1702), dated 20/9/1413 AH, accompanied by a report from the committee that inspected the site of the aforementioned mosque, which reads as follows: As submitted by the citizen (M. S. 'A. Q) ( al-Darb village )
because traces of a mosque exist within the courtyard of his house , and since you ordered the formation of a committee from the Waqf Authority, the court, and the Commission to inspect the aforementioned site, the committee was completed, they met, and they supervised the site on 16/9/1413 AH. They found that of the aforementioned mosque, only simple marks remain, which barely distinguish it. Its dimensions are as follows: fifteen meters in length from east to west, and eight meters in width from north to south. As for its distance from the mosque where Jumu'ah and congregational prayers are held, it is approximately fifty meters, even though one sitting at the site of this mosque's traces can hear the iqamah in the mosque where Jumu'ah and congregational prayers are performed. As for its utility, it is of no use, neither in the present nor in the future. As for its harm within the courtyard at the present time, it is a nuisance to the owner of the house. As for its establishment and habitation in the past, it was inhabited during the previous period when fear afflicted its people, such that a person did not feel safe for his life, and the present sees what the absent does not see.
