The second question of Fatwa No. ( 2340 )
Q 2: We are in a country where Christians, polytheists, and ignorant Muslims are mixed together, so we do not know whether they mentioned the name of Allah over their slaughtered animals or not. What is the ruling on eating from the slaughter of all these people? It is difficult to distinguish between their slaughters, indeed there is hardship and difficulty in doing so. There are also other animals slaughtered with imported machines from the lands of the disbelievers. What is the ruling?
Vol. 2: If the matter is as described, where those who slaughter the animals from among the People of the Book, the polytheists, and the ignorant Muslims are mixed together, and their slaughtered animals are not distinguished, and it is not known whether they invoked the name of Allah over them, then it is forbidden for one whose situation regarding the slaughterers is mixed to eat from their slaughtered animals. This is because the original ruling is the prohibition of domesticated animals and animals of a similar status, unless they are slaughtered with a lawful slaughter. In this issue, there is doubt regarding the slaughter: is it lawful or not? This is due to the mixing of the slaughterers, some of whom have lawful slaughter, and some do not, such as the polytheist and the innovator from the ignorant Muslims who hold innovations involving shirk (associating partners with Allah). As for one who can distinguish their slaughtered animals, let him eat from what was slaughtered by a Muslim, or by a Person of the Book who is known to have invoked the name of Allah over his slaughtered animal, or about whom it is not known whether he invoked the name of Allah or not. He should not eat from the slaughter of a polytheist or a Muslim innovator who holds innovations involving shirk, whether they invoked the name of Allah over it or not. It is recommended for the Muslim to be cautious for himself in all matters of his religion, and to seek out what is lawful in his food, drink, clothing, and all his affairs. In such cases as those asked about, the people of the Sunnah strive to choose for themselves those who slaughter for them, and to distribute it to them in a manner free from doubt and without any burden on the slaughterer or the consumer. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
This is the Shari'ah, and in this matter there is doubt regarding the slaughter: is it according to the Shari'ah or not? This is due to the mixing of the slaughterers, some of whose slaughter is lawful and some of whose slaughter is not, such as the polytheist and the innovator among the ignorant Muslims who commit innovations of shirk (associating partners with Allah). As for those whose slaughtered animals are distinguished, let them eat from what was slaughtered by a Muslim, or by a People of the Book (Ahl al-Kitab) who is known to have mentioned the name of Allah upon his slaughter, or about whom it is not known whether he mentioned the name of Allah or not. And do not eat from the slaughter of the polytheist or the Muslim innovator who commits innovations of shirk, whether they mention the name of Allah upon it or not. It is recommended (mustahabb) for the Muslim to be cautious for himself in all matters of his religion, and to seek out what is lawful (halal) in his food, drink, clothing, and all his affairs. So in such cases as what was asked about, the people of the Sunnah and the community (Ahl al-Sunnah wa al-Jama'ah) strive to choose for themselves who will slaughter for them, and to have it distributed to them in a way that leaves no doubt and no blame on the slaughterer or the consumer. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
