Fatwa No. ( 21611 )
Praise be to Allah alone, and blessings and peace be upon His Messenger, his family, and his Companions. As for what follows: The Permanent Committee for Scholarly Research and Ifta has reviewed the question submitted by the Honorable Head of the Courts of the Tabuk Region, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars, with number (4241) and date 14/7/1421 AH. The letter of his Eminence contained a question
from one of the sisters, and this is the text of his Eminence's letter: I present to your Eminence that the citizen (G. A. A.) came to me accompanied by her husband (S. A. A.), and she stated that her father passed away some time ago, leaving behind assets including real estate and other property. She demanded her share of the inheritance. When her mother learned of the demand, she became angry with her and said: "You are only demanding to eat up the money." At that, she said to her: "I want to give away my disabled sister's share, and my brother (A)'s share, and I am waiving my right to my share." Her mother refused to accept that, and refused to accept the waiver, and said: "I disavow you and everyone who takes his right." At that, she said: "I vow for the sake of Allah the Exalted that my entire share of the inheritance is charity on my behalf and on behalf of my father." I said this after my mother refused to greet me and pushed me with her hand. I am now asking: How should I deal with my vow? Is it binding? What is obligatory to do religiously to clear my conscience? Knowing that part of my share is real estate and I have a partner in it, who is my brother. Should I take possession of the rental income and give it in charity, or should I sell it and give the proceeds in charity? She added: "After the vow, I said in my heart in the same place: My share is forbidden to me and to my children." The Mufti's Eminence: I hope that after reviewing what has been mentioned, you will study it and provide information on the ruling of her vow, whether it is obligatory to fulfill it, regarding the retention of her share with her brother and giving the rental income in charity, and regarding the ruling of her forbidding this share. May Allah reward you, and may Allah reward you with good, and may Allah protect you, and peace.

After the Committee's study of the inquiry, it answered that the aforementioned vow falls under the category of vows made in anger and stubbornness, so an oath expiation is required, which is: feeding ten poor people, or clothing them, or freeing a believing slave. Whoever cannot find the means to do so must fast for three days. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
