Q: Does breastfeeding with a paternal uncle prohibit marriage to the daughters of another paternal uncle from a wife other than the grandmother? The uncle is the father of the daughters, and the father is the father of the uncle who was breastfed with him. The wet nurse says: I do not know how many sucklings there were, and the infant is in a state of illness and cannot be breastfed? We ask for an answer to this, may Allah assist you.
A: The breastfeeding that prohibits marriage is five sucklings or more within the two years. So, if your breastfeeding with your paternal uncle was from his mother in this manner, you are a brother to your paternal uncle through breastfeeding from the side of the mother and the father, and a brother to your other paternal uncles through breastfeeding from the side of the father. He the Exalted said:[An-Nisa 4:23] up to His saying the Exalted: [An-Nisa 4:23] And He the Exalted said: [Al-Baqarah 2:233] ,
And it is established that the Prophet (peace and blessings be upon him) said:Sunan Abi Dawud 2055Sahih (Al-Albani) , and it is established from the hadith of 'A'ishah (may Allah be pleased with her) that she said: (There was in what was revealed of the Qur'an: (Ten known sucklings prohibit) then it was abrogated by: (Five known) and the Messenger of Allah (peace and blessings be upon him) passed away while the matter was on that). Knowing that a suckling is: that the child holds the breast then sucks milk from it; if he leaves it and returns and sucks milk, it is a second suckling, and so on. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
