Q: I have a cousin whose father was breastfed by my wife's mother, along with my wife's sister from the same mother, and her father is three years younger than my wife.
My question is: Is it permissible for my cousin's son to marry one of my daughters , or is he their maternal uncle by virtue of his breastfeeding with their maternal aunt, who is three years younger than their mother? Please inform us, may Allah reward you with good.
A: The condition for breastfeeding that establishes prohibition is that it occurs within the first two years of the child's life, and that it consists of five breastfeedings or more. The definition of a breastfeeding is that the child holds the breast and sucks milk; if he releases it to rest or moves to another breast, it counts as one breastfeeding, and so on until five breastfeedings are completed. If it falls short by even one breastfeeding, it does not establish prohibition. This is based on the statement of Allah the Exalted regarding those who are prohibited:[An-Nisa 4:23], and the statement of the Prophet (peace and blessings be upon him) in the hadith agreed upon by al-Bukhari and Muslim: Sunan Ibn Majah 1937Sahih (Darussalam).
