Q: What is the ruling onthe ruling on one who insults the Messenger (peace and blessings be upon him), curses him, and insults the Lord (Glorified and Exalted is He), and has not issued a repentance up to this day, and this occurred from him in our presence and in the presence of a large gathering of people of knowledge and faith? His wife informed us that this is not the first time; rather, he continuously dares to engage in such insults. She wants to know from us today whether, according to the Shari'ah, she is still considered his wife, or whether their marriage has ended after this apostasy? For your information, the husband does not pray at all, and he engages in singing
and music at weddings and mixed gatherings. What is your advice to this poor wife? We ask the Lord the Exalted to reward you and keep you as a treasure and light for the Muslims in the world. And peace be upon you and the mercy of Allah and His blessings.
A: Cursing Allah (Glorified and Exalted is He) is major shirk (associating partners with Allah) and apostasy from Islam if the one cursing claims to be a Muslim. Likewise, cursing the Messenger (peace and blessings be upon him) is major shirk by the consensus of the scholars. Likewise, abandoning the prayer is major shirk, even if he does not deny its obligation, according to the most correct of the scholars' opinions. It is obligatory to refer his case to the Shari'ah court. As for the wife, she must refrain from allowing him access to her if she knows what you mentioned, until his case is concluded by the court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
