Q: There is no doubt that the act of the people of Lut is among the most vile of deeds. Is repentance accepted from one who commits this major sin without the hudud punishment being carried out against him? Is carrying out the hudud punishment a condition for sincere repentance? The one who commits this major sin (sodomy) is an open sinner; does repentance wipe away his open sinfulness? Is it possible for the one who commits
This major sin or any other major sin to be among the righteous? What should this person do if his country does not implement the hudud of Allah? What is the solution for this person, given that he has suffered from this illness since childhood and is now approximately twenty years old? What is the correct hudud for this heinous crime (sodomy), especially since this person both committed the act and was subjected to it? Is it, as some of our shaykhs say, that the hudud for this crime (sodomy) is left to the ruler, since nothing has been established regarding it from the Prophet (peace and blessings be upon him), and the four Caliphs did not agree on a single hudud for it? Please issue a ruling for us, may Allah reward you, may Allah reward you with good, and may He keep your steps firm.

A: First: The Muslims are in agreement that the act of sodomy is among the major sins that Allah the Exalted has forbidden in His Book. Allah the Exalted said:
(165) Do you approach males among the worlds (166) And leave what your Lord has created for you as mates? But you are a people transgressing."أَتَأْتُونَ الذُّكْرَانَ مِنَ الْعَالَمِينَ (165) وَتَذَرُونَ مَا خَلَقَ لَكُمْ رَبُّكُمْ مِنْ أَزْوَاجِكُمْ بَلْ أَنْتُمْ قَوْمٌ عَادُونَ
[Ash-Shu'ara 26:165-166]
meaning: transgressing from what is lawful to what is forbidden. And al-Tirmidhi , al-Nasa'i , and Ibn Hibban in his (Sahih) reported that the Prophet (peace and blessings be upon him) said:
Allah will not look at a man who has intercourse with a man or a woman through the anus.لا ينظر الله إلى رجل أتى ذكرًا أو امرأة في دبرها
Bulugh al-Maram 8:57
. Second: The door of repentance is open to all sinners, even disbelievers, until the sun rises from the west. The conditions of repentance from the rights of Allah are:
ceasing the sin, feeling remorse for what has passed, and resolving not to return to it. The implementation of the hudud is not a condition of repentance. Allah the Exalted said:
Say, "O My servants who have transgressed against themselves [by sinning], do not despair of the mercy of Allah. Indeed, Allah forgives all sinsقُلْ يَا عِبَادِيَ الَّذِينَ أَسْرَفُوا عَلَى أَنْفُسِهِمْ لاَ تَقْنَطُوا مِنْ رَحْمَةِ اللَّهِ إِنَّ اللَّهَ يَغْفِرُ الذُّنُوبَ جَمِيعًا
[Az-Zumar 39:53]
And He said:
The repentance accepted by Allah is only for those who do wrong in ignorance [or carelessness] and then repent soon after. It is those to whom Allah will turn in forgiveness, and Allah is ever Knowing and Wise.إِنَّمَا التَّوْبَةُ عَلَى اللَّهِ لِلَّذِينَ يَعْمَلُونَ السُّوءَ بِجَهَالَةٍ ثُمَّ يَتُوبُونَ مِنْ قَرِيبٍ فَأُولَئِكَ يَتُوبُ اللَّهُ عَلَيْهِمْ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا
[An-Nisa 4:17]
Third: It is recommended for one who falls into any of the sins to cover himself with the cover of Allah and not expose himself, and to seek forgiveness from Allah and repent to Him between himself and his Lord; for what al-Hakim and al-Bayhaqi reported:
Avoid these abominable things that Allah has forbidden, and whoever touches any of them, let him cover himself with the cover of Allah the Exalted and repent to Allah, for whoever exposes his page to us, We will punish him with the Book of Allahاجتنبوا هذه القاذورات التي نهى الله عنها، فمن ألم بشيء من ذلك فليستتر بستر الله تعالى، وليتب إلى الله، فإنه من يبد لنا صفحته نقم عليه كتاب الله
. And al-Dhahabi mentioned that its origin is in the two Sahihs. As for the legal hudud for this crime, it is referred to the legal ruler, who is the one who looks into the case and its circumstances. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
