Q: Is it permissible to sell and purchase birth certificates and invest in them ?
A: It is not permissible to sell or purchase birth certificates, nor to invest in them, such as when a person sells his family’s birth certificate to another so that the latter can invest in these companies using the names of the certificate holders as if they were his sons, when in reality they are not his sons. The person should cooperate with the state to which he belongs in applying its regulations regarding these certificates, provided that these regulations do not conflict with the Islamic Shari'ah. If so, this is cooperation in righteousness and piety, which Allah has commanded in His saying:[Al-Ma'idah 5:2]. Deviating from the regulations in a way that brings corruption to the individual, society, and the state is cooperation in sin and aggression, which Allah the Exalted has forbidden in His saying: [Al-Ma'idah 5:2]. Also, this is lying, and lying is forbidden. Furthermore, it is consuming the wealth of people through falsehood on both sides, because each of them took the money through a forbidden means, namely lying, deception, and betrayal of the state.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
