Q: Is it permissible to perform the Duha prayer during official working hours , especially if the number of worshippers increases to a point that may lead to delays in completing official work? We hope the answer will be in writing. May Allah reward you with good.
A: The principle is that voluntary prayers are performed in the homes, as the Prophet (peace and blessings be upon him) said:
The most excellent prayer of a person is (that which he prays) in his house except that which is prescribed (the five congregational prayers).أفضل صلاة المرء في بيته إلا المكتوبة
Bulugh al-Maram 2:313
, and he (peace and blessings be upon him) also said:
Observe some of your prayers in your houses and do not make them graves.اجعلوا من صلاتكم في بيوتكم ولا تتخذوها قبورًا

, agreed upon by al-Bukhari and Muslim. Accordingly, it is not befitting
for an employee to neglect the work that is obligatory upon him for the sake of a voluntary prayer; because the Duha prayer is a recommended practice (sunnah), so one does not leave an obligation for the sake of a recommended practice. The employee can pray the Duha prayer at home before coming to work, after the sun has risen the length of a spear, meaning after the prohibited time has passed, which is estimated to be about fifteen minutes after sunrise. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
