Q: A person of ambiguous sex: 1 - Raised as a female until the age of 18. 2 - The genitalia are closer to female. 3 - One testicle is in an abnormal position. 4 - Genetic analysis indicates male (X, Y) (x. y). 5 - There is no uterus or ovaries in the abdomen, nor breasts. 6 - Preliminary tests indicate she is female approximately 60%. 7 - The patient and her family wish for her to be raised as a woman. 8 - The operation to convert her to male is very complex. 9 - The operation to convert her to female is much easier, with the administration of some hormones. 10 - She cannot marry as a man or a woman, even if the operation is performed. 11 - The appearance and body structure are much closer to male.
I ask the esteemed scholars to issue a legal ruling on this matter at the earliest opportunity, if possible; as they are currently suspending the operation until the legal ruling is issued. May Allah protect you.

A: If it is expected that this person’s condition will not be distinguished as male or female after the operation, and he cannot marry as a man or a woman, then the operation should not be performed in this case; because performing it at that time would be futile. Rather, its performance should be postponed until his condition changes to one where differentiation is expected from the operation, and benefit can be derived from it; due to the saying of the Prophet (peace and blessings be upon him):
Your blood, your properties, your honors and your skins (i.e., bodies) are as sacred to one anotherإن دماءكم وأموالكم وأعراضكم وأبشاركم عليكم حرام
