The fourth question of Fatwa number ( 10719 )
Q7: Some Orientalists, communists, and others ignorant of the just Islamic legislation claim that Islam has established punishments that cannot be applied in the twentieth century. Can those punishments that were applied in the desert be applied? Is it permissible to cut off a hand because it stole a quarter of a dinar? Is it permissible to flog the adulterer, or stone him because of a reckless impulse he committed?
A7 : Indeed, Allah the Exalted is All-Knowing and Wise, and He is the One who legislated the laws, and He is the One who made Muhammad (peace and blessings be upon him) the Seal of the Prophets, and made His law general and the final of the laws, and He is more merciful to His servants than they are to themselves, so He legislates for them what benefits them in this world and the Hereafter. So whatever their conditions may be, whether civilization or otherwise, there is no rectification for them except by applying the law of their Prophet Muhammad (peace and blessings be upon him). And the Persians and the Romans were in the time of the Prophet (peace and blessings be upon him), and they had reached a great degree of civilization,
and the Ummah (the Muslim community) agreed that the Shari'ah (Islamic sacred law) is applied to them as to others, so it is not far-fetched that hudud (the fixed Qur'anic punishments) and qisas (retaliation in kind) be applied to this Ummah after it has reached the level of civilization it has reached; rather, this is obligatory, and experience is the strongest proof, so let them begin and the truth will speak.
