Q: I divorced my wife (K. H. 'A. S.) with a triple divorce in accordance with the Sunnah, because I heard a report about her that compromised her honor. I wrote the divorce document without inquiring into the truth of the matter. I was then informed that the statement for which I divorced my wife was not true. I have now regretted it, and I am currently within the period during which I can take her back. Therefore, I request a ruling on this matter.
A: If the situation is as the questioner described, then the divorce he pronounced does not take effect with respect to his wife. This is because it was a divorce pronounced on the basis of an event he believed had occurred before the divorce itself was uttered. It was then revealed to him that nothing of what had been the cause of the divorce had actually happened on her part. The taking back (raj'ah) that he performed was based on the assumption that the divorce was valid. Since it has been established that the divorce is not valid, there is no place for the taking back.
Consequently, the wife remains in his marriage bond based on the marriage that was in effect. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
