Q: We are a husband and wife living in Taiwan and we have no children. We have reached the age of forty, and we wish to adopt an abandoned newborn child and a girl who is three years old. Neither of them is from the same family. We discussed this matter with our imam in Taipei , and he referred us to the Grand Mufti in the Kingdom to obtain a sound opinion on the matter. We ask you to kindly inform us of your opinion on the matter, and how we should treat them
from childhood until they reach maturity. We ask Allah to guide all Muslims to the right path. May Allah reward you with good.
A: It is not permissible for you to adopt the abandoned child or the aforementioned girl, nor any other children who are not your legitimate children; because Allah has forbidden adoption in Islam, and invalidated the adoption that was practiced in the pre-Islamic age of ignorance and the early period of Islam. Among this was the adoption by the Messenger of Allah (peace and blessings be upon him) of Zayd ibn Harithah . Allah the Exalted said:[Al-Ahzab 33:4] The Messenger of Allah (peace and blessings be upon him) also forbade every Muslim man and woman from attributing a person to himself or to another when he is not so, or claiming kinship with a person or tribe while lying. What indicates this is what was narrated by Abu Dharr (may Allah be pleased with him), that he heard the Prophet (peace and blessings be upon him) say: Sahih al-Bukhari 3508 Agreed upon by al-Bukhari and Muslim. In another narration: Sahih al-Bukhari 3509 ... the hadith. Therefore, it is obligatory that every person be attributed to his father. If he has no known father
and he has a patron (wali) through whom he is attributed, then he is attributed to him. If he has no patron, he is called by the name of brotherhood in religion, and one says to him: "O my brother," or "O my sister"; because of the saying of Allah the Exalted:[Al-Ahzab 33:5] It is prescribed for you to be kind to them and to have custody of them if they have no one from their relatives to take care of them. You will have reward and recompense from Allah for that. If they remain with you until maturity and there is no breastfeeding that creates a prohibition between you, then they are strangers to you. It is not permissible for the husband to be alone with the woman, nor to look at her. It is not permissible for the wife to be alone with the man, nor to look at him or for him to look at her. The woman must observe the prescribed hijab from the man. Likewise, it is not permissible to travel with them without a mahram. The same applies between the boy and the girl when they reach maturity, if there is no breastfeeding that creates a prohibition between them; she is a stranger to him. It is not permissible for them to be alone together, and the woman must observe the prescribed hijab from him. It is not permissible for him to travel with her without a mahram. ليس من رجل ادعى لغير أبيه وهو يعلمه إلا كفر، ومن ادعى قوما ليس له فيهم نسب فليتبوأ مقعده من النارVerily, one of the worst lies is to claim falsely to be the son of someone other than one's real father
إن من أعظم الفرى أن يدعى الرجل إلى غير أبيهand he has a patron (wali) through whom he is attributed, then he is attributed to him. ادْعُوهُمْ لآبَائِهِمْ هُوَ أَقْسَطُ عِنْدَ اللَّهِ فَإِنْ لَمْ تَعْلَمُوا آبَاءَهُمْ فَإِخْوَانُكُمْ فِي الدِّينِ وَمَوَالِيكُمْ وَلَيْسَ عَلَيْكُمْ جُنَاحٌ فِيمَا أَخْطَأْتُمْ بِهِ وَلَكِنْ مَا تَعَمَّدَتْ قُلُوبُكُمْover them, and no residuary male heirs, then the reference in that matter is to the Imam or his deputy, such as the judge.
