Q: I proposed to a woman and she agreed at the beginning of the proposal. After a short time, she refused. Then there was a pause of about a year. I went to their place, and the woman and her brother were present. A minor disagreement arose between us, and she became upset. I said to her, while her brother was present: "I am no longer proposing to you after this time, and consider me like your brother here," meaning: I told her: "Consider me a mahram (a relative one may not marry) to you, like your brother." I said this in a moment of intense anger, and I did not realize I had made a mistake until after the words left my mouth in anger. I know that I desire to marry that girl, and since I want to propose to her again and marry her if she agrees, I ask your Eminence to inform me: does that word mentioned above make her forbidden to me, or do I owe an expiation, or what is required of me if I marry her? I am waiting until the fatwa from your Eminence arrives.
A: If the matter is as you described, it is obligatory for you to pay the expiation for an oath if you marry her, and she does not become forbidden to you because of that; because at the time of the prohibition she is not your wife, and whoever makes lawful what is forbidden must pay the expiation for an oath. The expiation is: feeding ten poor people, or clothing them, or freeing a believing slave. If you cannot find [the means], then fast for three days.
