Fatwa No. ( 3334 )
Q: I wrote a power of attorney for divorce in my own handwriting and then changed my mind, and I tore up the power of attorney before I sent it to my client, and there were some of my brothers present who informed my uncle, who is my wife’s father,
so he took his daughter from me along with her children, claiming that it was a divorce. Is this a divorce or not?
A: If the situation is as you described, that you wrote a power of attorney for a man to divorce your wife, and you changed your mind and tore up the power of attorney document before you sent it, then no divorce takes place on your account because of that. Likewise, if you sent the agency to the agent and then revoked it before the agent pronounced the divorce, no divorce takes place. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
