Q2: I bought a television set and said to my wife: “If you turn on the television to any non-religious program, you are forbidden to me.” Then I came in and found the television showing a play, so I asked her about it, and she said: “I forgot to turn it off after the religious program,” so what is the ruling of the Shari'ah in this matter?
A2: If the situation is as you described, that she forgot to turn it off after the religious program, then the husband does not break his oath. However, his initial statement to his wife: “If you turn on… you are forbidden to me” is not permissible; rather, it is an encroachment upon the right of Allah; because making things forbidden and permissible belongs to Allah alone. He the Exalted said:
O you who have believed, do not prohibit the good things which Allah has made lawful to you and do not transgress. Indeed, Allah does not like transgressors.يَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللَّهُ لَكُمْ وَلاَ تَعْتَدُوا إِنَّ اللَّهَ لاَ يُحِبُّ الْمُعْتَدِينَ
[Al-Ma'idah 5:87]
And He said:
O Prophet, why do you prohibit [yourself from] what Allah has made lawful for you, seeking the approval of your wives? And Allah is Forgiving and Merciful.يَا أَيُّهَا النَّبِيُّ لِمَ تُحَرِّمُ مَا أَحَلَّ اللَّهُ لَكَ تَبْتَغِي مَرْضَاةَ أَزْوَاجِكَ وَاللَّهُ غَفُورٌ رَحِيمٌ
[At-Tahrim 66:1]
And the wife should not turn on the television to anything other than religious programs, and she should be careful to turn it off when the religious program ends. And you owe an oath expiation if she intentionally turned it on to some of the programs you intended to prevent her from watching; because this statement is considered an oath in the most correct
of the scholars' opinions. And it is obligatory for you and for her not to turn on the television to the forbidden programs of songs, musical instruments, and reprehensible plays, and other things that Allah has forbidden. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
