Q: The questioner appointed the wife's maternal uncle to cut the divorce paper for his wife, but he revoked the appointment and informed them of the news through one of her relatives, saying: "Her maternal uncle will not cut the paper for her." I ask for your ruling.

A: The questioner's appointment of the wife's maternal uncle to cut the divorce paper for her is valid. If this maternal uncle divorced this wife before the husband revoked his appointment, then the divorce has taken place. If it was not the third divorce and he took her back during the waiting period, then the taking back is valid. If she has already exited the waiting period, then a new contract is required with her consent and a bridal gift. If this divorce was the third, she is not lawful for him until she marries another husband. However, if the husband's revocation of the appointment of the wife's maternal uncle occurred before the divorce was pronounced by the uncle, and the uncle knew of this and pronounced the divorce afterwards, then this divorce does not take place; because it did not meet a place capable of accepting it, as it did not issue from one who truly or legally possesses the authority to do so. Consequently, the wife remains in the protection of her husband. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
