Q: Since I haveappointed a person to act on my behalf in divorcing my wife with a divorce in accordance with the Sunnah twelve years ago, and she has not married since, is this permissible?And since I wish to take her back if she wishes.
A: If your agent in her divorce divorced her with a Sunnah divorce, and she has completed the waiting period, and this divorce was not the third of three divorces, then you may marry her with a new contract and a new mahr with her consent. If he divorced her in a manner other than the Sunnah divorce, it did not take place, because you did not appoint him for that. If your agent did not carry out the divorce for which you appointed him, she is still your wife, so you have the right to reconcile with her and take her back to your home. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
