Q: I inform Your Eminence that I was traveling in the desert with my brother (S. M. H.). During our journey, our car hit a speed bump. When we hit the bump, my brother's head struck the car's dashboard. I called out to my brother, but he did not respond to me. After approximately half an hour, he responded to me. I took him to the Thulayth Hospital, which is located approximately 175 kilometers away. He was admitted to the hospital on 28/12/1413 AH. I visited him at the hospital along with the traffic director, his family, and some of his companions. He signed a waiver and informed his family and companions that he was waiving his rights against his brother. After that, he was transferred to the Asir Hospital, and he passed away at the Asir Hospital on the night of Wednesday, corresponding to 12/1/1414 AH. According to the medical report, the cause of death was convulsions in the circulatory system due to fractures in the spine resulting from a traffic accident. I have already paid the blood money to his family. In this letter, I request Your Eminence to guide me regarding what is required of me in terms of the rights of Allah (Glorified and Exalted is He). May Allah reward you with good.
A: If the situation is as you described in the question, then you must pay the expiation for accidental killing. This is: freeing a believing slave. If you cannot find one, then you must fast for two consecutive months.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
