The questioner : We have some brothers who swear by divorce falsely more than thirty times a day. What is the ruling on those people? Does the divorce take effect on them? And if the answer is that it does take effect, what should they do about what has already passed?

The Shaykh : The correct opinion among the scholars is that swearing by divorce does not make it a divorce, and its ruling is the ruling of an oath. An oath regarding a past matter made falsely is forbidden, because lying is forbidden in its essence. The Prophet (peace and blessings be upon him) explained that lying is among the signs of the hypocrites. So these people should repent to Allah (Glorified and Exalted is He) for what occurred from them and not return to such a thing. As for the divorce, it does not take effect on them.
