Question:
The questioner: Your Eminence! This is our sister the questioner saying: My question, Your Eminence, is that she is a girl married to a man who constantly swears by divorce in all his actions and words, and he often repeats this phrase: "I am divorced." She says: Does the divorce take effect? I go to my parents' house, and I am pregnant, and I give birth to a child, and I return to my husband. Does I sin in this life with him?

Answer:
The Shaykh: It is obligatory that if the husband pronounces divorce, he should seek a scholarly ruling. And if he divorces, go to your parents' house until he seeks a ruling from the scholars. It is not befitting for a man to use divorce, and to be lax regarding divorce, for divorce is the title of separation. So it is obligatory for the believer to guard his tongue, and to protect it from what is not befitting, and to beware of divorce except with certainty. If you see separation, there is no harm. But for him to use divorce without certainty, and to play with divorce, this is not permissible. In the hadith:
The most hated of permissible things to Allah is divorce.أبغض الحلال إلى الله الطلاق

The Shaykh: And divorce is the means of separation, so it is obligatory for the believer to guard his tongue, and to protect his tongue from what is not befitting. And if he divorces, it is obligatory for him to ask the scholars so that he may see clearly. And it is obligatory for her to go to her parents' house, and to refrain from him until he asks the scholars about what occurred from him, and until the scholars give him a ruling regarding his divorce. We ask Allah for guidance for all of us.
