Fatwa number ( 16225 )
Q: We inform you that there is a deceased man who has children and their mother, and he has a debt of more than one hundred thousand (100,000). He has allowances. Should the allowances be used to pay off the debt, or should they remain for the orphans? Please note that the orphans have nothing to eat from, and they rely on the generosity of benefactors, may Allah reward them with good. Also, they have no housing other than renting. We ask your Eminence
to clarify for us whether we should pay off the debt from the allowances allocated to them, knowing that his allowances amount to sixty thousand riyals (60,000), which is not enough to cover the debt recorded against him? And may Allah reward you with good.
A: Paying off debts takes precedence over inheritance, so it is obligatory to first rush to pay off the debt of the deceased. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
