The first question of Fatwa No. ( 19411 )
Q1: A father passed away, leaving behind money and sons. However, the eldest son (their elder brother) did not divide the money among them; instead, he took it and traded with it. After a year, he made a substantial profit from that money. After this, he wanted to divide the money among his brothers. Should he divide the original capital among them, or should he divide the entire amount, including the profit he earned after the father's death?
A1: It is obligatory to hand over the money and its profit to the deceased's heirs. If you dispute this matter, the reference is to the Shari'ah court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
