Q 3, 4: A man says: My father gave him twenty thousand riyals during his lifetime to trade with, and after returning it to him during his lifetime, he took half the profit and his father did not know about it. Is that permissible for him? And if it is not permissible, what should he do with it now that his father has died? Another man says: His father gave him twenty thousand riyals during his lifetime to work with, but now his father has died. Does he return it to the heirs with its profit and take half the profit? With the note that his father did not say to him anything other than: “Work with it,” and no agreement was reached with his son to take any of the profit.
A: It is obligatory for the person mentioned to pay the principal amounts along with their profits to the heirs, as well as the half of the profit he took, as long as his father did not assign him a known share of the profit.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
