The Ruling on Temporary Marriage

Machine translationRead the Arabic original
The sixth question of the fatwa number (3810)
Q6: What is the ruling in Islam regarding temporary marriage?
A6: Temporary marriage is forbidden and invalid if it takes place; for what was narrated by al-Bukhari and Muslim (may Allah have mercy on them both), from 'Ali ibn Abi Talib (may Allah be pleased with him),
The Messenger of Allah (ﷺ) forbade mut’ah marriage and the meat of donkeys at the time of Khaibar.أن رسول الله صلى الله عليه وسلم، نهى عن نكاح المتعة وعن لحوم الحمر الأهلية زمن خيبر
Musnad Ahmad 592Sahih (Darussalam)

And in a narration
On the day of Khaibar, Allah's Messenger (ﷺ) forbade the Mut'a (i.e. temporary marriage)نهى عن متعة النساء يوم خيبر،
Sahih al-Bukhari 4216
, al-Khattabi (may Allah have mercy on him) said: The prohibition of temporary marriage is by consensus, except from some of the Shi'ah. And it is not valid according to their principle of referring to 'Ali in matters of disagreement, for it is authentically reported from 'Ali that it was abrogated. al-Bayhaqi transmitted from Ja'far ibn Muhammad that he was asked about temporary marriage, and he said: It is nothing but fornication. And when Muslim narrated in his *Sahih* from Subayrah ibn Ma'bad al-Juhani , from the Prophet (peace and blessings be upon him), that he said:
I had permitted you to contract temporary marriage with women, but Allah has forbidden it (now) until the Day of Resurrection. So he who has any (woman with this type of marriage contract) he should let her off, and do not take back anything you have given to them (as dower).إني قد كنت قد أذنت لكم في الاستمتاع من النساء، وإن الله قد حرم ذلك إلى يوم القيامة، فمن كان عنده منهن شيء فليخل سبيله ولا تأخذوا مما آتيتموهن شيئًا
Sahih Muslim 1406d

And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
