Q1: We are here in a foreign land, in a country where immorality is widespread. One of the young men asked a shaykh (a scholar or teacher) who came to us from Kuwait about the ruling on temporary marriage , and he permitted it on the condition that this not be disclosed to the girl. In truth, I have great doubt about the validity of this fatwa (a scholarly legal ruling), and it has spread fitnah (trial, discord or temptation) among the young men. I ask for clarification of this issue and what one should do if he fears fitnah (trial, discord or temptation) for himself?
A1: Temporary marriage is invalid (batil); because it is a form of pleasure-seeking (mut'ah), and pleasure-seeking (mut'ah) is forbidden (muharram) by scholarly consensus (ijma'). Valid marriage is that a man marries with the intention of maintaining the marital bond and continuing in it. If the wife is suitable for him and compatible with him, he keeps her; otherwise, he divorces her. Allah the Exalted said:[Al-Baqarah 2:229] . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
