Q2: What is the ruling on marriage of exchange, where the two parties agree that each will marry the other, and each will give a mahr to his wife .
A2: If a man marries his ward to a man on the condition that the other man marries his ward to him, this is the marriage of shighar, which the Prophet (peace and blessings be upon him) forbade. This is what some people call marriage of exchange, and it is a defective marriage, whether a mahr is named in it or not, and whether mutual consent is reached or not. However, if this man proposes to the other man’s ward, and the other man proposes to his ward, without any condition, and the marriage takes place between them with the consent of the two women, along with the presence of the other conditions of marriage, there is no disagreement on this, and it is not considered a marriage of shighar in that case.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
