Q3: We know that a disbeliever does not inherit from a Muslim, and likewise a Muslim does not inherit from a disbeliever, due to the established legal principle in this matter. So what about a person who testifies that there is no god but Allah and that Muhammad is the Messenger of Allah, who establishes the prayer, gives zakah, fasts, and performs Hajj, but who holds beliefs regarding the awliya (close friends of Allah) and the righteous (the belief in their ability to benefit and harm)? Does the ruling that he neither inherits nor is inherited from apply to him?
A3: One who believes that the dead can benefit or harm, or to whom one calls for aid, or whom one invokes besides Allah, is a mushrik (one who associates partners with Allah), even if he testifies that there is no god but Allah and fasts and prays; because he has invalidated these acts through shirk (associating partners with Allah). Allah the Exalted said:[Az-Zumar 39:65]
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
