Q2: Does a polytheist who commits major shirk (associating partners with Allah) inherit or be inherited from, or not? Knowing that this man continued to give advice for years, but he believes in what they call the awliya (close friends of Allah) among the buried, and he persists in his shirk. Please inform us, may Allah reward you.
A2: A polytheist who commits major shirk, if he dies upon that, is treated as a disbeliever. Therefore, his believing relatives do not inherit from him, nor is the funeral prayer performed for him, nor is he buried in the graves of Muslims, nor is he supplicated for with forgiveness; due to the saying of Allah the Exalted:
It is not for the Prophet and those who have believed to ask forgiveness for the polytheists, even if they were relatives, after it has become clear to them that they are companions of Hellfire.مَا كَانَ لِلنَّبِيِّ وَالَّذِينَ آمَنُوا أَنْ يَسْتَغْفِرُوا لِلْمُشْرِكِينَ وَلَوْ كَانُوا أُولِي قُرْبَى مِنْ بَعْدِ مَا تَبَيَّنَ لَهُمْ أَنَّهُمْ أَصْحَابُ الْجَحِيمِ
[At-Tawbah 9:113]
, and the saying of the Prophet
(peace and blessings be upon him):
A Muslim may not inherit from an infidel nor an infidel from a Muslim.لا يرث المسلم الكافر، ولا الكافر المسلم

. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
