The first question of Fatwa No. ( 19330 )
Q1: A woman has a house, and she is alone and advanced in age, and she wants to bequeath her house to her brother’s children, who are from her mother, knowing
that she has brothers from her father. So who is more deserving of the bequest? Please inform us of this, may you be rewarded.
A1: A bequest to a non-heir is permissible up to one-third or less, but anything exceeding that is referred to the heirs regarding their share; if they approve it, it is valid, otherwise it is not. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
