The first question of Fatwa number ( 10799 )
Q1: I have a two-story house in Riyadh, and I would like to bequeath it to my children and my wife. What is your opinion on this? May Allah reward you with good.
A1: It is not recommended to make a bequest to the heirs; for what the five [collections] other than al-Nasa'i narrated from Abu Umamah (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said:
Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir.إن الله قد أعطى كل ذي حق حقه، فلا وصية لوارث
Sunan Abi Dawud 2870Hasan Sahih (Al-Albani)
. However, it is prescribed for you to endow the aforementioned residence for the use of the needy among the heirs, along with maintaining it when necessary.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
