Q: I previously asked you about what the remaining income of the one-third is spent on after the execution of the bequest, and you answered that it is spent on acts of righteousness according to what the agent deems appropriate. I wish to have the fatwa in writing so that I may keep it, and so that the agency is accepted from me by the person I see as suitable in case I am unable to perform it myself; therefore, I hope you will kindly give me a written fatwa to that effect. May Allah reward you with the best reward, and may He guide your steps to what is in the interest of Islam and the Muslims.
A: If the situation is as described, it is obligatory first to execute the bequest
with the sacrificial animals from the income of the one-third for those for whom it was designated, and what remains of its income after that is to be spent on avenues of righteousness, such as the poor and the needy, and what is needed for building mosques or repairing them and the like. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
