Disposing of the surplus from the house's rental income after fulfilling the specific bequests

Machine translationRead the Arabic original
Fatwa No. ( 3482 )
Q: My grandfather bequeathed one-third of his wealth to my father, stipulating that from this one-third, forty sa' of dates be given to the poor during Ramadan, a permanent lamp be provided for the mosque, and three sacrificial animals be offered: one for him, one for his father, and one for his mother. The remainder of the one-third was to be spent on righteous deeds. My father designated one-third of my grandfather's estate as a house. Both of them have passed away (may Allah have mercy on them). This house is rented out, and the rental income covers the sacrifices, the dates, and the mosque lamp. There is a surplus from the rental income, and the house does not need repairs. What should be done with this surplus income? Please advise us, and may Allah reward you.
A: If the situation is as you described, then dispose of the surplus from the house's rental income after fulfilling the specific bequests you mentioned, by spending it on righteous deeds. Do not withhold it, in order to carry out your grandfather's bequest and to seek the continuation of the righteous deeds he specified. Among the righteous deeds are giving charity to the poor and the needy, maintaining mosques, and the like. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
