Q: Does the bequest below include movable property and other assets, or not? The text of the bequest is: Praise be to Allah alone, and blessings and peace be upon the one after whom there is no prophet. And after: I, the undersigned, 'Ali ibn Ahmad ibn 'Abd al-Khaleefah, being in good health, of sound mind, and of my own free will, after my testimony that there is no god but Allah alone, with no partner, and that Muhammad is His slave and His Messenger, whom He sent with guidance and the religion of truth to make it prevail over all religions, even if the mushrikin (those who associate partners with Allah) dislike it, have bequeathed that after my death, one-third of my wealth be given to each of the two children of my daughter Lawlaw, namely: Ahmad ibn 'Abd al-'Aziz and his sister Jaliyana, each of them receiving ten thousand Bahraini dinars; and to each of the two daughters of my daughter Zubaydah, namely: Fatimah and 'Aishah, daughters of Yusuf Saqr al-Khaleefah, each of them receiving ten thousand Bahraini dinars; and to Qasim Muhammad al-Khaleefah, ten thousand Bahraini dinars. As for the remainder, it is to be used to purchase a property in Bahrain , and its revenue is to be spent on
the elderly and the disabled, and on the trustee of the aforementioned property to repair it if the need arises. For clarification, I have drafted this and authorized those who witness it, and Allah is sufficient as a witness.
Then whoever alters the bequest after he has heard it - the sin is only upon those who have altered it. Indeed, Allah is Hearing and Knowing.فَمَنْ بَدَّلَهُ بَعْدَمَا سَمِعَهُ فَإِنَّمَا إِثْمُهُ عَلَى الَّذِينَ يُبَدِّلُونَهُ إِنَّ اللَّهَ سَمِيعٌ عَلِيمٌ
[Al-Baqarah 2:181]
Dated 30 Muharram 1404 AH.

A: After the Permanent Committee for Scholarly Research and Ifta in the Kingdom of Saudi Arabia studied this bequest, it responded that it is obligatory to extract one-third of the aforementioned person's wealth from all his assets; including real estate, cash, and others, after paying off any debts he owes. From the one-third, what he bequeathed to the two children of his daughter Lawlaw, namely: Ahmad ibn 'Abd al-'Aziz and his sister Jaliyana, etc., is to be distributed, and the remainder is to be used to purchase real estate that becomes a waqf (endowment) for the aforementioned 'Ali, with its proceeds to be spent on the elderly and the disabled as he mentioned, after repairing it as needed. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
