Q6: A man has a piece of agricultural land, which is an endowment for the mosque, and it is next to the village. The person in possession of it needs it to build a house on it, and to replace the clay with better and more clay, for the previous endowment clay was not suitable, while the replacement clay is suitable for the well. Is what is mentioned permissible or not permissible?
A6: If the person in possession of the endowed agricultural land is the supervisor of the endowment, he has no right to dispose of this plot for himself or for another by sale or exchange, except in a manner that brings benefit and interest to the endowment. This disposition must be carried out through the Shari'ah judge whose jurisdiction and court cover the location of this plot. If he is not the supervisor of the endowment, it is not permissible for him
to dispose of this plot except through the supervisor, and the supervisor only disposes of the endowment as previously explained. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
