Q: Some of the brothers came to me and asked me to sell them fifty bags of rice. I said to him, "Will you take twenty-five bags of rice and twenty-five bags of sugar?" He agreed with me on what I mentioned. When he went to
look for a buyer for it, he found one and said to him, "I will buy it, but I want it all to be rice." He returned to me. When I entered the warehouse, I found that the rice was twenty-five bags, and the sale was completed in this state. I was not able to obtain the other twenty-five bags until about twenty-five days later. I do not know if there is any sin (transgression) that befalls me in this sale because it was not available to me, and because of its delay?
A: Your sale of the rice that is in your possession is valid, but it is not permissible to sell what you do not have; because you do not own it. One of the conditions for the validity of this sale is that the seller must own what he is selling and have it in his possession.
