Informing the buyer of a defect in the item sold, even if it is minor

Machine translationRead the Arabic original
The seventh question of Fatwa No. ( 1843 )
Q7: I bought a car and found a minor defect in it, so I sold it, and I did not inform the buyer of the defect. Is this considered deception or not?
A7: Yes, this is considered deception, and it is known that deception is forbidden; because of what is established from the saying of the Prophet (peace and blessings be upon him):
Whoever cheats us is not one of us.من غشنا فليس منا
Sunan Ibn Majah 2225Da'if (Darussalam)
, and you must seek forgiveness from Allah and repent to Him, and hasten to inform the buyer and let him know of the defect that was in the car; to clear your conscience. If he waives his right, praise be to Allah, otherwise agree with him either to pay an amount for the defect, or to take back the car and return the price. If no agreement is reached, it is a dispute to be adjudicated by the judge of your jurisdiction, and if you are unable to find him, give charity on his behalf equivalent to the defect.
