Q18: What is the ruling on intercepting goods from their owners in the street before they enter the market and buying from them?
A18: It is forbidden to intercept the owners of goods in the street before they enter the places prepared for displaying and selling merchandise; because this falls under the issue of intercepting travelers, which is prohibited; due to the hadith narrated by Imam Ahmad , which states:
and do not go out to meet the merchandise, (but one must wait) till it is brought down to the market.ولا تلقوا السلع حتى يهبط بها السوق

and it was narrated by al-Bukhari in his Sahih from 'Abdullah ibn 'Umar (may Allah be pleased with them both), vol. 4, p. 373, and what was narrated by al-Bukhari in his Sahih from Nafi' from 'Abdullah ibn 'Umar (may Allah be pleased with him), who said:
We used to intercept travelers, and we would buy food from them, so the Prophet (peace and blessings be upon him) forbade us to sell it until it reached the food marketكنا نتلقى الركبان، فنشتري منهم الطعام، فنهانا النبي صلى الله عليه وسلم أن نبيعه حتى يبلغ به سوق الطعام
, and in another wording from Nafi' , from 'Abdullah (may Allah be pleased with him), who said:
they used to buy grain in the upper part of the market and sell it in the same spot, but God’s Messenger forbade them to sell it there before removing itكانوا يبتاعون الطعام في أعلى السوق، فيبيعونه في مكانه، فنهاهم رسول الله صلى الله عليه وسلم أن يبيعوه في مكانه حتى ينقلوه

, and in a narration by Muslim, that the Messenger of Allah (peace and blessings be upon him) said:
Do not meet the merchant in the way and enter into business transaction with him, and whoever meets him and buys from him (and in case it is done, see) that when the owner of (merchandise) comes into the market (and finds that he has been paid less price) he has the option (to declare the transaction null and void).لا تلقوا الجلب، فمن تلقاه فاشترى منه فإذا أتى سيده السوق فهو بالخيار

, and accordingly, if the owner of the goods does not bring them down to the market prepared for selling them therein, it is forbidden to intercept their owners, and whoever intercepts them before they reach the market is sinful and disobedient to Allah the Exalted, if he is aware of the prohibition; because of the deception and misleading of the seller, and the harm caused to the people of the market, and if this is established and the seller suffers a loss that is not customary, the seller has the option between confirming the sale and canceling the sale, and this falls under the option of loss.
