Fatwa number ( 78 )
Q: We have a house in Makkah that is an endowment (waqf) consisting of three floors with its amenities, along with a shop. Its total income is four thousand and three hundred riyals, and it is the income for the widows and orphans, the heirs of the late Muhammad Rami (may Allah have mercy on him). We wish to replace it with a house in
Jeddah, as you know, its income will be doubled, so I beseech you to guide us.
A:IndeedMakkah al-Mukarramahis a noble land, the secure land of Allah, and other lands are inferior to it, and its houses are more sought after for sale and lease than those inJeddah, and it has a thriving market for trade and leasing during the season of Hajj and 'Umrah, which is not found inJeddah,so if there is sometimes a slump in it or in some of its houses, it is due to a temporary circumstance that will disappear when it disappears, and therefore it is not permissible for the person in charge of the house about which the question was asked to sell it and buy another house with its price in a place other thanMakkah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
