Fatwa number ( 17196 )
Q: A citizen approached us, informing us that he has a two-story villa property. He borrowed money from the Real Estate Development Fund to build it and wants to make it a valid endowment. Given that it is pledged in favor of the Real Estate Development Fund, and since the occupant does not reside in it, we hope you will answer us regarding its permissibility or impermissibility. Peace be upon you.
A: One of the conditions for the endowed property is that ownership must be fully vested in the owner, free from any right of another person attached to it. Therefore, if a house is pledged to an individual or a public entity, it is not permissible to endow it until the pledge is released from it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
