Q1: Is there a sound report from the Prophet (peace and blessings be upon him) stating: (Whoever breaks the bone of a dead man is as if he broke the bone of a living Muslim)?
A1: The hadith regarding breaking the bone of a deceased person being like breaking it while alive is established. It was transmitted as marfu' (traced to the Prophet) and mawquf (stopping at a Companion). The marfu' narration is found in the Musannaf of 'Abd al-Razzaq , in the Sunan of Abu Dawud and Ibn Majah , and in the Sahih of Ibn Hibban , all with their respective chains, from 'Umarah bint 'Abd al-Rahman from 'A'ishah (may Allah be pleased with her), who said: The Messenger of Allah (peace and blessings be upon him) said:Sunan Ibn Majah 1616Hasan (Darussalam). 'Abd al-Razzaq titled the section: (Chapter on Breaking the Bone of a Deceased Person), then he presented the hadith with its chain. Abu Dawud titled the section: (Chapter on whether a digger who finds a bone should avoid that place), then he presented the hadith with its chain. Ibn Majah titled the section: (Chapter on the prohibition of breaking the bones of a deceased person), then he presented the hadith with its chain. Al-Hafiz al-Haythami titled the section in Mawa'id al-Zam'an ila Zawa'id Ibn Hibban : (Chapter on one who harms a deceased person), and he presented the hadith with its chain. As for the mawquf narration, Imam Malik mentioned it in
Al-Muwatta' in what was transmitted regarding concealment, with its chain to 'A'ishah (may Allah be pleased with her), who used to say:Muwatta Malik 16:46 meaning in terms of sin. Imam al-Shafi'i mentioned it in al-Umm in the chapter: (What occurs after burial), from Imam Malik , that it reached him that 'A'ishah (may Allah be pleased with her) said: Muwatta Malik 16:46. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
