The third and seventh questions of Fatwa No. ( 9328 )
Q3: If a person says the takbir in a voluntary prayer without having used the siwak, and he remembers after saying the takbir, before the opening supplication and before beginning to recite Surat al-Fatihah, is it permissible for him to use the siwak without excessive movement, or should he leave it off due to the dislike of movement?
A3: It is prescribed for the one praying to use the siwak before entering into the prayer; for it is established from the Prophet (peace and blessings be upon him) that he said:Sunan Abi Dawud 47Sahih (Al-Albani) , but if he did not use the siwak before entering the prayer, he should not use it after saying the takbir for the prayer; for that is a contradiction of the Sunnah.
Q7: If the imam says the takbir for the prayer and the person is busy, and the mu'adhdhin is calling the iqamah for the prayer, either completing a verse or completing a page, however long it takes, and the imam says the takbir and the person has not used the siwak, and in the imam's recitation of the opening supplication the ma'mum uses the siwak, is it permissible for him to use the siwak for its virtue, or should he say the takbir with the imam for the virtue of following the imam? Which is better: using the siwak even if the ma'mum is delayed after the imam, or leaving off the siwak and following the imam immediately?
A7: The Sunnah for him is to finish the recitation upon hearing the iqamah and to respond to the one calling the iqamah as he responds to the mu'adhdhin, and to use the siwak before entering into the prayer, and not to do that, i.e., using the siwak, after the imam's takbir, but rather to hasten to follow, due to the generality of the hadiths indicating the prescription of the ma'mum following the imam, such as his saying (peace and blessings be upon him):Sahih Muslim 414a
