The second question of Fatwa No. ( 6201 ):


Q2: We want to know the ruling on one who does not declare a disbeliever to be a disbeliever .
A2: For one whose disbelief is established, it is obligatory to believe in his disbelief, to rule that he is a disbeliever, and for the one in authority to execute the punishment for apostasy upon him if he does not repent. And whoever does not declare a disbeliever to be a disbeliever, whose disbelief is established, is himself a disbeliever, unless he has a doubt in that matter, in which case it must be clarified. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
