The third question of Fatwa No. (3786) :
Q3: Regardingthe ruling on the disbelievers of the People of the Book residing among usknowing that they do not pay the jizyah (tax on protected non-Muslims), but rather they are hostile to the people of Islam and do not leave any opportunity that brings harm and damage to Islam without participating in it, whether secretly or openly. So how should one deal with them? And how does a Muslim show his lack of loyalty to them in this situation?
A3: As for the disbelievers who make peace with the Muslims and refrain from harming them, we treat them with the best treatment and fulfill the duty of Islam toward them, including kindness, sincere advice, guidance, and calling them to Islam, establishing the proof against them, hoping that they will enter the religion of Islam. If they respond, praise be to Allah. If they refuse, we demand from them the rights that are obligatory upon them, as indicated by the Book and the Sunnah. If they refuse, we fight them until the word of Allah is the highest and the word of disbelief is the lowest. As for those among them who are arrogant toward the Muslims, and who conspire against them with harm and plot evil for them, it is obligatory for the Muslims to call them to Islam. If they refuse, they are to be fought, in support of the religion and to prevent their harm from reaching the Muslims. Allah the Exalted said:
You will not find a people who believe in Allah and the Last Day having affection for those who oppose Allah and His Messenger, even if they were their fathers or their sons or their brothers or their kindred. Those - He has decreed within their hearts faith and supported them with spirit from Himلاَ تَجِدُ قَوْمًا يُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الآخِرِ يُوَادُّونَ مَنْ حَادَّ اللَّهَ وَرَسُولَهُ وَلَوْ كَانُوا آبَاءَهُمْ أَوْ أَبْنَاءَهُمْ أَوْ إِخْوَانَهُمْ أَوْ عَشِيرَتَهُمْ أُولَئِكَ كَتَبَ فِي قُلُوبِهِمُ الإِيمَانَ وَأَيَّدَهُمْ بِرُوحٍ مِنْهُ
[Al-Mujadila 58:22]

And He the Exalted said:
(8) Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly. (9) Allah only forbids you from those who fight you because of religion and expel you from your homes and aid in your expulsion - [forbids] that you make allies of them. And whoever makes allies of them, then it is those who are the wrongdoers.لاَ يَنْهَاكُمُ اللَّهُ عَنِ الَّذِينَ لَمْ يُقَاتِلُوكُمْ فِي الدِّينِ وَلَمْ يُخْرِجُوكُمْ مِنْ دِيَارِكُمْ أَنْ تَبَرُّوهُمْ وَتُقْسِطُوا إِلَيْهِمْ إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ (8) إِنَّمَا يَنْهَاكُمُ اللَّهُ عَنِ الَّذِينَ قَاتَلُوكُمْ فِي الدِّينِ وَأَخْرَجُوكُمْ مِنْ دِيَارِكُمْ وَظَاهَرُوا عَلَى إِخْرَاجِكُمْ أَنْ تَوَلَّوْهُمْ وَمَنْ يَتَوَلَّهُمْ فَأُولَئِكَ هُمُ الظَّالِمُونَ
[Al-Mumtahanah 60:8-9]
